Indian sentenced for insulting Gambian President, citizens

(PANA) - Gambia - Gambia's lower court, the Kanifing Magistrate’s court, has sentenced an Indian national,
Maliesh D. Bhojwani, to a fine of D1,000 (about US$ 34) or an option of three months imprisonment, The Voice newspaper reported from here Wednesday. Bhojwani was convicted by magistrate Sheriff B. Tabally after being found guilty of breach of peace. The Indian was accused of calling Gambians lazy
black monkeys, including President Yayah Jammeh, an accusation he denied.According to the particulars of the offence, on 29 January, 2011, somewhere along the Sayerr Jobe Avenue in Serrekunda, Kanifing Municipality, which is a public place, Bhojwani used abusive words on one Isatou Singhateh, saying that, ‘Gambians are lazy black monkeys’, a manner likely to cause a breach of peace.
The suspect pleaded not guilty to the charge and his counsel, Musa Bachilly. in his plea of mitigation, said Bhojwani was a first time offender and urged the court to temper justice with mercy.
Bachilly said the convict was alone in the country and urged the court not to impose custodial sentence on him as he has responsibilities back home in India.

Hey, Where is the Democracy of Expression in the Gambia and is the President above the Constitution or what is wrong here?
Gambians are however to be Blamed for such acts as almost all of the Middle class and the helpless Poor in the Gambian Society are encouraging Racism in the society.. in other words they are giving more respect to light Colored than dark Skinned people in the society thereby Discriminating themselves.
Now,a man is said to have been tried and found guilty for calling Gambians 'lazy black monkeys'.
Whilst I do not condorn racist comments,(if this could be called that),I find it almost childish and certainly, a waste of funds, to try people for making silly comments during senseless arguements. What purpose does this serve: That you cannot make derogatory comments about Jammeh! Jammeh has called Gambian men 'Lazy' more times than I can count.
Unless the statement has been captured on tape,it worries me that the court may have relied on 'hearsay' evidence to convict the man. Otherwise,how could the prosecution proof that the man said those words when he(the accused) denied the allegations.
Maybe 'hearsay' evidence was enough in these cases.
I've seen such in Barra ferry terminal where a young man insulting the entire Gambian police, just he was being asked for his identification becoz he was then traveling with some "Wazungu Gals" He started to rain insults on the officer.
So, if we doesn't give respect to our own officers who will respect even Arafang Yahya ?
