Editorial: Gambians aghast by death sentence

no_death_penaltyGambians are horror-struck by the death sentence passed on former head of the country’s military, Lang Tombong Tamba and seven other men, on Thursday.
The eight men were accused of attempting to overthrow the government of President Yahya Jammeh.
‘Very sad,’ ‘unfortunate,’ ‘outraged’… seem to be the favorable words for the few who summon enough courage to mention the issue at all from within Gambia.no_death_penalty
“This is a very sad day for the country … these people are killers…” stated a source who wouldn’t want to be named, via facebook.
“There was no truth in this co-called treason trial,” said another one via the same medium. “Gambians just don’t talk about it because of the obvious reason of fear.”
But certainly there is one man who dared said it openly.
Assan Martin is arguably Gambia’s most outspoken human right activist at present. His views are representative of the resurgence of the long held feeling of lack of trust in the country’s judiciary. That is probably nowhere well expressed than on this very forum.
A human right lawyer, Lawyer Martin is well-known for his uncompromising attitude towards the country’s judicial system and its overall human rights situation.
Martin, on Thursday, relayed the general feeling of Gambians to the Voice of America. He said the people were shocked and disappointed by the court’s decision.
“I can tell you that the reaction today is very somber and it is a big sad day in our legal history for this court’s judgment. This is a shocking judgment (and) a sad judgment for many Gambians… I can honestly tell you in my own view that all those evidence and the testimonies were very, very weak,” he said.
Going by Martin’s remark, lack of confidence on the Nigerian dominated Gambian judiciary is not limited to well-known opponents of the regime, despite the deafening silence that characterizes the legal fraternity within the country.
“Today, I can tell you one thing that public confidence in our legal system is very low…we are grappling with the decision of the court to be honest,” Martin said, adding: “I believe that anybody who does anything should be dealt with according to law, but there should be enough evidence to warrant a conviction.”
The caliber of witnesses forwarded by the prosecution has been the most focus of attention throughout the over four months’ trial. The largely incoherent testimonies of star witness Ebrima Marreh, an estranged nephew of the main accused, made a perfectly suspicious combination with the largely questionable character of the second witness, a self confessed drug dealer imported from Guinea Bissau.
magistrate-martinAccording to Lawyer Martin, Gambians are of the opinion that the judicial process was not thoroughly followed. He said the decision undermines the confidence the people repose in the judicial system.
Despite the general feeling of melancholy about Thursday’s development, there is however a sizeable section of Gambian society, both home and abroad, which appeared apathetic to the plight of the convicted coup plotters. Some are merely angered by the alleged involvement of especially Lang Tombong in similar treatment meted out to other victims of the wrath of the regime.
“There is no hatred from me to Lang and the others,” wrote a commentator who blogs here on Jollof News under the name mafuji. But they asked: “Where were they when the family of Ebou Lowe, Chief Manneh and others were mercilessly murdered by their regime? As the saying goes: 'The Evil That Men Do Leaves After Them.”
Even traditional defenders of the Gambian government on this forum appeared moved by the death sentence.
“Sad!!! Some of them were arrogant public servants but I really felt sorry for them and their families. Hopefully Jilanka (President Yahya Jammeh) will pardon them one day,” said a notable supporter of the regime who blogs under the name Farato Jatou.
The situation is no different from what is in Gambia, except that obvious fear of reprisal is forcing people to keep their feelings in their chest.
“People are sad, but don’t give a damn… you know Gambia…? People don’t want trouble,” remarked a civil servant who obviously wouldn’t want to be mentioned.
Death Warrant unlikely
Meanwhile, while defense lawyers are said to be currently contemplating appealing the death penalty ruling within the next constitutionally guaranteed 30 days, there is general feeling that President Yahya Jammeh is not likely to append his signature for a death warrant for the men, one of whom happens to be the most decorated security personnel in Gambian history, thanks to him. Analysts believe the verdict is more of a warning against the numerous alleged coups that have besieged this country since 1994.

Gambian,

How did we even know that these people were 'planning to cause a civil war in the Gambia'?
See, the problem wit Jammeh is that he is ruthless, that is and has been the issue between him and us, his opponents... We do not hate to see development in Gambia, I swear, we do not!
You acn not bank on the outcome of these sorts of trial to vindicate Jammeh, will you?
This is the issue here...

Those PAJEROS with the number plates JUDICIARY ONE,JUDICIARY TWO and others are a regular part of the convoy that goes to see off or welcome the president at the airport.Their homes are heavily guarded by personnel of the PIU (Police Intervention Unit)

These crooked judges are very close to Jammeh and there is no way that they can ever return a verdict against his government.

Nigerians are lucky that Gambians are peace-loving people. If it was in other places all those Nigerian fake spare shops along Brikama High Way would have gone up in flames after this verdict was announced by their fellow countrymen upon citizens of the Gambia.
I do believe however, that we are being pushed too far by Jammeh. Those that associate with him (Nigerians) should not be surprised when the inevitable wrath of the people is unleashed upon them.

It is time for reflection. President Jammeh is not the man to deal with. The Likes of FJC, Baba K Jobe, Daba Marenah, Musa jammeh and Tumbul Tamba all sank as a result of blind allegiance to the dictator. One would have ask a question about the triggers of general Tamba's historic Military decorations. All of it rised and bumped on the hills of betrayal and self-centredness. Today he and his corhorts are on the verge of testing the bitter pills of proping up a coward at the expense of our collective well-being. I can't see him executed but he can be assured of a lengthy jail term. For as long as his big brother remains his excellency, he shall be far from freedom. The president will continue to keep the mercenary judges because they attend to his desires than would have been with Gambian born and bred judges. For those in the army, NIA and police should look over their shoulders and treat all gambians as one. Lt Lowe, Bah, Marenah others perished because of Tamba and co.

It is time to rise up aginst the mercenary judges and prosecutors employed only to send us into the filthy cells of Mile 2. Those Nigerians have to go. President Jammeh himself was a stauncn opponent of the Nigerian Technical teams in the army. How comes today he is quiet happy to dine and wine with the Nigerian mercenary jugdges. It must borne in mind that these are the kind of people with no chances of becoming a magisterate in their native Nigeria. lets rise up against the increasing Nigerian dominace our country. Let them out!

Quoting Mr. Anonymous:
I believe in fair dispensation of justice, so do I in innocence until proven guilty. But I equally and strongly believe in the rule of law and the maintenance of peace and stability. But I find myself in a rather precarious situstion and simply put, am torn. Torn because I want to accord due deligence to all of these (sometimes) conflicting moralities. May the will of Allah ultimately prevail. For he alone know the truth and the whole truth.

Mr Anonymous, you haven't said anything. can you come plain? What is you stance on this drama?

Jammeh or whoever he think he is, he is just one creatures of Allah. He in his continued intimidating of Gambians will do no good to him, he shall surely face justice, and wats most sorry about it is he will face it here and in the hereafter. As for the Military this is a warning you ought to be wise or your faith will be that of the bunch of criminals prosecuted. They where all part of the killings dats been happening in the country and now he needs a new badge of criminals to silence these ones as they know a lot so as to bury evidence against him. Be rest assured Mr Jammeh that ur days are numbered and shall face it (JUSTICE).
