D30 Million Bail Bond for Pristine Consulting Official
Wednesday, 04 May 2011 19:42
(Foroyaa) - Vacation Judge Justice Awa Bah, on Tuesday 3 May, granted bail to Mr. Assan Touray, the remanded Chief
Technology Officer (CTO) of Pristine Consulting Company, who is involved in four count criminal charges against him, his brother Mr. Abdourahman Touray, the Chief Executive Officer (CEO) of Pristine Consulting Company, is said to have absconded. The Court asked him to deposit cash amount of D10 Million with two Gambian sureties who have landed properties valued at 10 Million Dalasi.
In delivering the ruling on the bail issue, Justice Bah said that the defence has filed a motion dated 19 April and filed it on 20 April supported by a fifteen paragraph affidavit and an additional three paragraph to support their bail application. Justice Bah stated that the motion filed by the accused person was seeking three prayers. She indicated that the State did not file in any affidavit in opposition to that of the accused person in case in the absence of any evidence, the Court can rely on the affidavit in support, which can be admitted by the Court. She noted that the State counsel indicated that it is not at all times that an affidavit is necessarily filed.
Justice Bah said that the Court has noticed that all the four count charges are bailable offences and that it is trite law that the discretion of bail lies with the Court and should not be excessive. She asserted that in granting bail, the Court has to consider the previous records of the accused person, whether he will abide by the bail condition and be available at any time the Court needs him and whether he will not tamper with the case. She said that the accused person was previously granted bail and that there was no evidence that he has tampered with the conditions as stipulated by the Court. She added that there is no doubt that it is sufficient enough to grant him bail.
Justice Bah upheld the bail application as thus; the accused person is ordered to deposit “In cash D10 Million with a reputable Commercial Bank, Two Gambian sureties who must provide title deeds valued at D10 million each and must be within the greater Banjul Area and that the accused person should deposit all his traveling documents with the Registrar of the Court”.
After the ruling of the Court, this reporter asked the family whether they would be able to fulfill the conditions as stipulated by the Court, the head of the family said only God knows, but was quick to add that the conditions are excessive. The accused person, Assan Touray said he is sure his family would be able to meet the conditions for his bail.
It could be recalled that Mr. Assan Touray, his company and brother Mr. Abdourahman Touray are charged with two counts of “Economic Crime contrary to section 5 (B) of the Economic Crimes Decree Specified offences Act”, one count of “Conspiracy to defraud the public” and one count of “Theft”.

Yaya Jammeh is a man that will give you a finger and take a hand. All those around him knows this even better.
I watched the interview and thanks for the link. He is talented and with a good government backing he will have done very good for gambia in identifying projects that will help Gambia public services develop and computerised to save money and time. Also IT geared to industrialisati on of Gambia. What another waste. Jammeh will eventually destroy Gambia development prospects.
I also notice that Bail in these courts in the Gambia are now a source of income and strategy. You pay huge amount and get bankrupt as punishment by challenging his dictorship or taste his notorious jail. I think this is the new directives he gives to the courts to deal with his opponents. D30million = $1089,000/£659.000 for bail for this man. They are gangters for real. No wonder their is no opposition in Gambia.
I remember watching this interview 9link above) saying to myself, this seemingly nice dude has no idea what he is getting into.
We still have people that cannot see anything wrong, the saddest part.
